1. scope of application
1.1. The user regulations serve to ensure safety, order and cleanliness in the “Degenbachsee” area in the municipality of Crailsheim-Jagstheim.
1.2. The Degenbachsee area is intended for public use, recreation, the promotion of health, sporting activities and leisure activities and is made available to the public for general use. It is therefore in their own interest to observe the user regulations.
1.3 By using the green and recreation area, the user submits to the ownership rights of the water board. In order to maintain public safety, order and cleanliness, the user regulations and all other orders issued must be complied with. The user regulations are binding for all persons on the premises.
1.4. The site comprises the demarcated and developed land and water areas, including the traffic and parking areas, as shown on the attached site plan. This is a binding part of the user regulations.
1.5. It is not permitted to stay in the adjacent private areas.
2. intended use and permitted types of use
2.1. The facility serves charitable purposes, in particular recreation, building, swimming and leisure activities.
The land areas are generally intended for quiet recreation; sporting activities are only permitted within the usual framework of family games and in the areas provided for this purpose.
2.2. The pitching of tents, caravans and mobile homes and overnight stays are strictly prohibited. For public events organized by local clubs, schools or church groups, exemptions can be granted upon application to the Crailsheim town council and after consultation with the lower nature conservation authority. The permit must be presented on request.
2.3. The eastern shore with its beach is primarily intended for bathing and swimming. Non-swimmers and users of swimming aids must stay in the area for non-swimmers. In the danger zone, there is an increased risk of injury due to shallow water with a possible risk of injury. pointed and sharp tree stumps and even danger to life due to the sudden appearance of strong whirlpools.
2.4. Boating of any kind, kayaking and stand-up paddling are prohibited on the water areas. Inflatable boats are exempt from this regulation.
2.5. The different types of use are shown on the attached site plan.
3. user group and opening hours
3.1. Use of the green and recreational area is permitted all year round and is generally open to all persons, unless there are health or regulatory reasons to the contrary.
3.2. Persons are excluded:
– which could endanger the general public (e.g. due to excessive consumption of alcohol and/or intoxicants);
– carrying animals, with the exception of guide dogs for the blind and therapy dogs; service dogs of the police, the penal system, the Federal Border Guard, the customs administration, the Federal Railways and the Federal Armed Forces on duty; dogs used to herd a flock; dogs that have passed the tests prescribed for rescue dogs and are used as rescue dogs for civil protection, disaster control or the rescue service, as well as dogs used in the security industry, insofar as the use requires this; hunting dogs in the context of hunting;
– who suffer from a notifiable communicable disease within the meaning of the Hygiene Protection Act;
– who are unable to move around safely without assistance.
3.3. Children under the age of seven are only permitted to enter and stay if accompanied by a supervisor over the age of 18. Parents are liable for their children.
3.4. The swimming season starts on 01.05. and ends on 30.09. of each year. Outside the bathing season, swimming in the lake or entering the ice surface is prohibited. Riding is generally prohibited.
3.5. In the case of school, club or community events, the teacher, the trainer or the organizer is responsible for compliance with the usage regulations. Events with 10 or more visitors must be registered in writing with the Crailsheim City Council in advance. The permit must be carried and presented on request.
4. behavior on the local recreation area
4.1. The green and recreational areas must be kept clean and treated with care. Any damage or soiling is prohibited and obliges the perpetrator to pay compensation. Visitors and users of the facility are required to maintain order, safety and hygiene. They must refrain from doing anything that is contrary to good morals and the maintenance of security, peace and order.
4.2. For the prevention of danger to life, health, property and possessions and for the protection of recreationists and the local recreation area is prohibited:
a. the driving and parking of motor vehicles in the area of the sunbathing lawns and outside the areas designated for such use by traffic signs; the wild setting up and parking of caravans, mobile homes and tents as well as wild camping overnight;
b. the use of disposable barbecues and gas barbecues; barbecuing is only permitted within the designated barbecue zone. You must bring your own fuel. Ashes and coal must not be placed in the existing waste garbage cans;
c. setting up open fires outside the facilities provided for this purpose; smoking in the toilets and sanitary facilities;
d. the use of dangerous, unhygienic or disgusting substances and objects and/or their discharge into the water as well as the cleaning of pets and water-polluting objects in the bathing lake;
e. to take pointed or sharp objects, bottles or similar fragile objects into the water or throw them in;
f. the use and operation of water pipes / shishas;
g. other recreationists
through sports practice and games. Only the areas intended for this purpose are to be used. Use at your own risk;
h. to push other persons into the water, to submerge them or to harass them in any other way;
i. soiling, wilful damage or other alteration of the green and water facilities and existing facilities (e.g. toilet facilities);
j. causing a nuisance to other visitors by making noise, in particular by operating radios or other sound and image receiving and reproducing devices, music and sound-generating instruments;
k. Wild animals may not be fed, willfully disturbed or hunted for no reason;
l. playing with hard balls and other hard thrown objects (e.g. stones) near the shore and outside the designated areas;
m. to illegally deposit objects and waste of any kind; waste may only be disposed of in the containers provided for this purpose;
n. Only members of the Jagstheim Fishing Association are permitted to fish at Degenbachsee with a valid permit; violations will be reported to the police.
4.3. Bathers may only use the local recreation area in normal swimwear. Users must also refrain from doing anything that is contrary to good morals, peace and cleanliness.
4.4. A service building with a kiosk and public toilets and sanitary facilities is available for those seeking recreation. The sale of goods of all kinds, including the sale of food and drink, the carrying out of advertising of all kinds, the distribution, sale or affixing of printed matter, the offering of commercial services, filming and photography for commercial purposes, the organization of amusements and the holding of meetings are not permitted unless special permission has been granted by the competent authority.
4.5. Swimming over the swimming area boundary is prohibited, as is swimming on the forest side and jumping in and diving under from the sun jetty.
5. supervision
5.1 The kiosk tenant, the members of the Jagstheim local council and the board members of the Jagstheim fishing association exercise domiciliary rights over all visitors. The supervisory staff is authorized to expel from the recreation area or ban from the premises persons who repeatedly violate these regulations despite warnings. Any objections will result in criminal charges for trespassing.
6. liability
6.1. Visitors stay and use the “Degenbachsee” recreation area at their own risk at any time of year. All visitors are responsible for informing themselves about the land and water conditions. There is no bathing supervision.
In the winter months, no checks are carried out on the load-bearing capacity of a possible layer of ice. Walking on a possible layer of ice is always at your own risk.
The use of the beach facilities and open spaces, including their traffic routes, is at your own risk. The City of Crailsheim is not liable for any damage resulting from the use of the green and recreational area. The traffic safety regulations remain unaffected.
6.2. Users shall indemnify the City of Crailsheim against all claims asserted against them by third parties arising from the use of the local recreation area.
6.3. No liability is accepted for accidents and injuries or for the destruction, damage or loss of items and valuables brought onto the premises. This also applies to vehicles and bicycles parked in the parking lots.
6.4. Violations of these user regulations are administrative offenses within the meaning of the German Administrative Offenses Act (OWiG). These can be. § 171 OWiG can be punished with a fine of up to € 1,000.00.
6.5. Anyone who causes damage to the City of Crailsheim by violating these usage regulations must remedy this damage immediately at their own expense after a single request with a reasonable deadline.
If the illegal condition is not remedied, the City of Crailsheim may, after prior warning and setting a deadline, remedy the situation at the expense of the offender. A prior warning and setting of a deadline is not necessary if the offender cannot be contacted, if there is imminent danger or if the immediate removal of the unlawful situation is necessary in the public interest.
The right to report the perpetrator(s) for criminal prosecution under the applicable criminal law remains unaffected.
7. dismissal
7.1. Persons can be expelled from the pitch by authorized persons if they act in a serious manner or repeatedly despite warnings.
1. contravene the provisions of these Terms of Use or orders issued on the basis of these Terms of Use,
2. offend against decency and morality or are prohibited from use in accordance with section 3.2. are closed.
7.2. In such cases, access to the stand and the open areas may also be prohibited for a certain period of time.
8. other
8.1. These user regulations come into force on the day after their publication for an indefinite period.
8.2. The provisions of the Police Ordinance on the Preservation of Public Safety and Order and against Environmentally Harmful Behavior of 29.04.2004, as amended, shall apply mutatis mutandis.
8.3. The place of jurisdiction for disputes arising from the use of the green and recreational area is Crailsheim.
